    I don’t want to spoil the moods here, but it doesn’t do me much, that Michael Jackson passed away. Years ago he already looked like a ghost of a shadow of a ghost, and now his time has come, obviously… It’s OK.

    And besides the moonwalk and that song \"Beat it\", that was not bad, he didn’t do me much music/dance-wise either…

    No seriously, but I might have said that actually. And changed my mind now, since I see that gold set appear multiple times on the market. And I have not seen the silver discs yet, except for my copy… But there must be more of those silver disced sets also I’m sure. I’m not sure what the collectors here think about this Intimate & Interactive set and it’s rarity?

    Second that. Because of these people (and they are on here also, you know who you are!) I have no high blood pressure, I’m not depressed, I don’t need any medicines so far, and the psycho has to wait a bit also. But I do have sleepless nights, teary moments and stomach pains sometimes, but that’s OK. Otherwise I would be a cold and heartless person… Which I know I’m not. :wink:

    @ Reggae: you hit it hard on the head there. That’s my feeling also. My lawyer says it’s almost impossible to prove that type of bank fraud, but he is considering to bring it in in appeal. Next month I will get a concept of his appeal papers.

    We did not really sign a paper at the Registered Accountant in 1997, but we made up a contract for the business that was registered at the Chambre of Commerce in 1995. In that business contract it clearly says that the partner that is continueing the business after the other partner left, will take over the debts and revenues. The Chambre also registred clearly my date of leaving in 1997, but the judge overlooked that too in his verdict. I managed to recover a copy of that contract in my most recent research, as it couldn’t be found before at curator nor Chambre. And I’m awaiting my lawyer’s comment if he will bring it in in appeal. Banks, by law, have to follow the business changes registered at the Chambre. Good point there too, Reggae. 8)

    And no, there will be 3 new judges in appeal that will look at this case, instead of 1 in round #1. Luckily!

    It went like this. In 1994, my ex-business partner wanted to buy a huge property of land, including a bungalow and a bicycle shop. He then wanted to sell the bungalow, sell or exploit the bicycle shop and build 1 or more new houses on the land that was left. Then a profit of 200.000 – 300.000 seemed likely. For the total buy a mortgage was needed, initially for a short period of course, of 650.000 (or 675.000, by head). But the bank asked for extra guarantees besides the property, which he could not deliver on his own, so I helped him a little for 33.750. In this way I became partner in the whole deal for 5%. So the bank gave us 650.000-675.000 so the notary could pay the seller of this whole property. But when the deal was closed at the notary, there was another paper to be signed (amongst many others) that said that my risk/guarantee was 375.000, so when the bank didn’t get the mortgage back at some point, they could claim me for this amount!

    So I left the company in 1997 to broaden my horizon in Amsterdam. We officially made reports about this at a Registered Accountant, we notified the bank, the Chamber of Commerce etc. Nobody ever spoke about this debt paper, that was only "hidden" in the files of the bank. Meanwhile the bungalow was sold, the bicycle shop was being exploited and my ex-business partner was waiting for permission to build on that land. That’s how I left him, and there was nothing special going on.

    Without me knowing anything (I had already moved to Amsterdam) my ex-business partner stopped paying intrest in 1999 and went bankrupt in 2000. The permission to build on that land never came, by the way, and that’s why the land is still there with this mortgage on it. Between 1997 and 2000 I heard nothing from bank nor curator. Only in 2001 I received a standard bank letter about intrest rates, and that surprised me as I had nothing to do with that bank anymore. So I called and they promised to take my name away of their files. And they did untill late 2004, when this other guy called me, saying they had found a paper with my signature that stated that they could claim 375.000 from me. I was like huh? wtf? no way! I remember I was part of that deal in 1994-1997, but I left it completely to my ex-business partner!

    And the rest is history… This stupid judge is on the hand of the bank obviously. And he doesn’t take into account that the land is still there for a value of roughly 300.000 Euro, so when it is sold for that amount at some point, and I paid 190.000 now, will I get the profits of 110.000 Euro then? Because the judge thinks I’m still partner in the business… But judge doesn’t want me to pay the unpaid intrest of the mortgage, because since he is bankrupt, my ex-business partner doesnt have to pay it either (deal between curator and bank). But the deal between curator and bank is ALSO that the bank will wait with the total claim untill the land is sold! And that part of the deal is forgotten in the verdict of 190.000!

    Next to this, and I know it’s all boring legal bullshit for most of you maybe, but there is this aging thing of 5 years. In general, after 5 years of doing nothing, in Holland people loose the right to claim. So we need a startdate and an enddate for this. The judge says it starts in 2000, and it ends in 2004, so no 5 years have passed. We said from the start: 1997 is the start year, and 2008 is the end year (difference of 11 years), because then the claim was known in a legal document. In Holland, to stop aging of claims, it is needed that a clear letter is send, registered by post, from party 1 to party 2 with a clear statement about "stop aging", "this and this exact amount" and "according this and this contract". This letter, or anything that looked like it, was never send, and the bank cannot prove they did send it. The judge however, states that only by contacting me in 2004 about a certain contract that might lead to a future claim, it was enough to stop the aging of the claim. Every lawyer I spoke, was totally surprised about this fact in the verdict, and they don’t understand how the judge could verdict like this.

    All in all, we have enough material to have high hopes for the appeal. Only, it is very costly to be involved in a lawsuit, and when the economy crisis strikes at the same time… hmm… you don’t want to be in my shoes, I’m sure… :wink:

    Actually only recently, when we did further research after the verdict in April. We are going to use this new material in appeal, I’m quite sure. Thing is, in 2004, 2006, 2008 when we did research on this old case of 1994/1995 not all papers were found/handed over to me/my lawyer, and we focused on the existing paper that clearly said 375.000 with my signature, so we cannot deny it’s existence. Remember, when you do a real estate business deal including land, bycicle shop, huge bungalow and goods, you have to sign like 20 papers. This was one of them, and afterwards the notary send me all copies, except this one.

    Then the main focus is first: prove I legally left the company in July 1997 so the debts went to my ex-business partner, and prove it has been "aged" after that date. Also prove that the bankruptcy deals made by the bank and the curator of my ex-business partner in 2000 (no intrest, no payback of mortgage, only after the sales of the property) should apply to me also.

    We got a tip from another lawyer that we should also look into even older history of 1994, how all guarantees were setup for the total deal. How the bank could allow me to sign for such a huge debt while I had a good, but normal job with a salary that only allowed me to sign for 1/10 of that debt. Then we found papers from my old employer (who co-signed for me) and we found a copy of a letter to the bank, but to another office, not being the head office of this bank. Did I still know all this after so many years? No… unfortunately not. You think the curator or the bank is helpful to me/my lawyer to hand over papers when we ask for them? Of course not… But we finally found them, and maybe they will be useful in appeal.

    But yeah, crazy story indeed. I can only hope we win the appeal later this year, then this bank has to pay a penalty also (like I have to pay the 20.000 Euro now) so I can pay my lawyer from that penalty. Yesterday, my lawyer said I can stop paying him as he will wait for the verdict in appeal. Meanwhile he will keep on working for me of course… I can breathe a little again, after last Friday on my job the announcement was done we will have another 15% pay cut to survive the economy crisis.

    Meanwhile, I’m quite sure the bank will bark, but not bite, to get the 190.000 Euro. If they try anything, like selling my house (which is under 100% mortgage anyway) or goods, or take parts of my salary (which dropped 35% by now anyway) and we win the appeal, then they have to pay a huge penalty for unnecessary damage caused.

    Wanna know the whole story in a nut shell?

    1994, I helped a friend buying a house and some land, I guaranteed for 33.750 dutch guilders on a total buy of 650.000 dutch guilders.
    1995, we decided to make a business of it, by accident/mistake I signed a debt paper of 375.000 (instead of 33.750). The notary never send me a copy of that contract. I did not become owner of the property.
    Summer 1997 I left the business, the bank was notified but never came back to me that still a paper needed to be taken care of.
    1999 my ex-business partner stopped paying the mortgage.
    2000 my ex-business partner went bankrupt.
    2001 I called the bank to ask them stop sending me post that they suddenly send by accident, they promised to do so, and they did.
    2004 the bank called me, saying they found a paper with my signature that I had to pay 375.000. I said I had nothing to do with it anymore since 1997. Bank says I still own the stuffs, but that lie was quickly uncovered.
    2006 the bank tried again with me, but my lawyer pushed them away.
    2008 suddenly the bank decides to put me into court for 375.000 mortgage + 350.000 intrest.
    April 2009 the judge says I have to pay 375.000 mortgage (= 170.000 Euro) + legal costs of 20.000 Euro, but no intrest.

    His motivation: the case was not "aged" since the aging term starts in 2000 (ex-business partner went bankrupt), and was ended in 2004 when the bank first contacted me. Aging term in NL is 5 years… But I didn’t have to pay the intrest he said, as the deal in the bankruptcy case of my ex-business partner was: no intrest calculation during bankruptcy period. So I profit from that intrest deal, but strangely I do not profit from the deal in the bankruptcy case that the bank is willing to wait for the sale of the property and only then the bank can claim the mortgage damage, if there is!

    And now the guys of the bank are chasing my ass with this verdict in their hands, that they want 190.000 Euro right now, which I do not have of course. After several years of taking loans for paying my lawyer I cannot take any further loans anymore, so I have to start doing paybacks of my loan now. But I still have to pay for the appeal also… Meanwhile, because of the economy crisis, in just a few months my nett salary dropped around 35%.

    Here you go… unfair as hell, but it’s my reality of today. From happy guy to survival mode in just a few months… :roll:

    Hehe, yeah, it is an idea. And it will happen when I loose the appeal. But I have high hopes that I don’t loose that appeal, and I will even get a (little) compensation for the shit they put me in when I win. Every lawyer and every insider that knows the details of my story, was surprised that the judge verdicted me (partly) responsible for the debt. When I loose the appeal, I will go to court and declare us bankrupt. In Holland we are kinda lucky, that it only lasts 3 years in cases when people cannot help getting bankrupt.

    Yesterday, I had the weirdest working day ever. And I feel very quiet inside today, kind of zen state. Humble, and happy.

    Weird, but also funny… :roll:

    OK, let me explain. Since one and a half month my life is kinda fucked up. And I mean really fucked up. On April 22, I lost a lawsuit against a bank (I’m going to appeal against it of course), but I have to pay 190,000 Euro (approx. US$ 265.000) now anyway. At least that’s what they want. I don’t have that of course, so they are trying to get my house and goods instead. I’ve done some preparations of course, so they won’t get everything, if something at all. Now they are trying to get my salary, to see if they can get some of that. A few days ago the bailiff of the bank made me fill in a form about these things…

    So, tensions are building up (understatement). No money anymore to collect SP. Almost no money anymore to pay my lawyer, who is on this case since 2006. And what happened on top of this all? Last Friday we got an announcement that we will get a salary cut of 15% at out company because of the economy crisis. Yes sir… You would say, this fucking bank and the fucking economy are doing a race together who brings me down on my knees first… Of course I felt this coming, we don’t have so much work anymore as we had before. But having my salary cut with 15%, then I’m bankrupt, and totally fucked up…

    So I already told my teamleader that when such thing would happen, I would leave the company and look for a job that would bring in some more money. She probably told the CEO of our company, as before the general announcement of the 15% pay cut he called me in and he told me I would get a compensation because he knows that we are having hard times, with the lawsuit and all. I was still very angry about this decision and told him I would leave anyway.

    Then, the weirdest thing ever happened. At around 23:00 Friday night I get a call on my mobile. Mr CEO himself… Crying, that he felt so sorry for us, that he is going to compensate generously, even from his private money if necessary, for the pay cut, and he also promised that when good times return (which might be soon, as he is talking with a big spender-invester) he will look very seriously into the posibility to give my girlfriend a management job at our company. He almost could not speak, he was all teary and emotional, and he made clear that he doesn’t want to loose such good employee like me… Tsss… :roll:

    Now, today, I went to do some work out for a few hours in the gym in our office with my girlfriend, she didn’t feel so well because of all the stress of the last few weeks, but we had a good time anyway. Before we went I found the sweetest email from a few friends that supported me by buying a fucking rare Smashing Pumpkins cd. I got chicken skin and tears when I read that. Anyway, then after the work out we went to do some shopping, I made pancakes with bacon for us 2 (smells good and tastes even better!), and after that we went for a walk and a long sit at the beach. It was beautiful weather, and more and more I felt calm, in a zen kind of way. Harmony. And with a feeling that when there is nothing else to lose anymore, you start to know your real friends. And you start enjoying very small things very intense also.

    People that don’t like coffee are sissies, and they have not been raised in a proper way by their parents, that’s just my humble opinion. :P

    That smell when I open the coffee tin, then that other heavenly smell in the kitchen when making the coffee on the stove, oh man… and then that first zip from my own homemade espresso… cloud 9! 8)
